SPOTLINK TERMS OF SERVICE

1) Introduction & Acceptance

Spotlink (“Spotlink,” “we,” “us,” or “our”) helps drivers know what’s happening at the curb before they stop.

Drivers leaving a curb space (“Spotters”) can share when and where they’re heading out. Drivers looking for parking (“Seekers”) can see nearby departures and curb-rule context in one place — helping reduce circling, stress, and surprise tickets.

Spotlink also includes optional tools designed to make curb rules easier to understand and manage:

CurbAI™ turns complex curb rules and timing into clear, human-readable guidance so you can make faster, more informed decisions before you arrive.

Ticket Guard™ lets you set reminders around upcoming curb-rule changes, helping you stay ahead of street cleaning, restrictions, and time-based rules.

Spotlink gives you information, not instructions. You stay in control at every step, and parking decisions are always yours.

By tapping Accept during sign-up, installing, or using Spotlink, you agree to these Terms. If you do not agree, do not use the Service.

2) Service Overview (Instant Curb Intelligence)

Problem: Drivers lose ~100 hours/year circling for legal parking. Garages charge $30–$60/hr; alternate-side tickets start at $65.

How Spotlink works

Spotter: sets departure time (“Leaving in 10 minutes”).
Seeker: pins a destination, sees live departures, spends SpotCoins, and receives guidance.
Auto-Link & Escrow: Coins are escrowed until the Seeker’s GPS crosses a 10-ft geofence around the departing vehicle.
CurbAI & Ticket Guard: informational tools that read posted rules, color-code blocks (🟢 🟡 🔴), and send real-time rule alerts depending on subscription tier.

3) Accounts, Eligibility & Safe Use

You must be 18+ and legally able to drive/park.Keep location permissions active for GPS-based features (Auto-Link, guidance, Ticket Guard).
Prohibited: GPS spoofing, blocking curbs illegally, harassment, off-platform transactions, multi-accounting, and unsafe driving.

One natural person per account. Identity or vehicle verification may be required.

3.1 SMS Communications & Consent

By verifying a phone number or checking the consent box during sign-up, you agree to receive transactional SMS messages from Spotlink (confirmations, alerts, security codes, service updates).

Message frequency varies. Message/data rates may apply.

Opt out anytime by:

replying STOP to any Spotlink SMS,
replying HELP for assistance, or
emailing support@spotlink.app.

We do not sell or share mobile numbers for marketing.

4) SpotCoin Token System

4.1 Parity & Packs

1 SpotCoin = $0.10 USD.

Packs:

$5 → 50 SpotCoins
$20 → 200 SpotCoins
$100 → 1,000 SpotCoins

4.2 Sign-Up & Referral

Welcome Pack: 50 bonus SpotCoins.

4.3 Subscriptions & Features (In-App Purchases)

These subscriptions are offered as in-app purchases through the App Store.

Apple Disclosure:

Subscriptions are billed to your Apple ID.
Subscriptions auto-renew unless canceled at least 24 hours before renewal.
Manage or cancel subscriptions at any time via Settings → Apple ID → Subscriptions.
Charges are processed by Apple; refund eligibility is determined solely by Apple’s refund policies.

4.4 Top-Ups & Withdrawals

Top-ups: $5–$100 | max $1,000/day.
Withdrawals: min $10, max $2,500/month (base coins only).
Withdrawal fee: 10% per withdrawal.

KYC/AML checks may apply.

5) Matching, Escrow & Auto-Link

A match forms when a Seeker selects a departure and funds escrow. Auto-Link triggers when the Seeker’s GPS enters the 10-ft geofence.
SpotCoins release to the Host immediately upon Auto-Link.

If GPS data is inconsistent, we may request additional confirmation.

6) Cancellations, Penalties & Failed Matches

6.1 Pre-Link Cancellation

Either party may cancel pre-Auto-Link with no penalty.

6.2 Host Cancels After Match

Seeker: 100% refund
Host penalized 30 SpotCoins (20 → Seeker, 10 → Ops)

6.3 Seeker Cancels After Match

Seeker: 100% refund
Seeker penalized 15 SpotCoins (10 → Host, 5 → Ops)

6.4 Late Arrival / No Show

If Seeker fails to arrive within the window, the penalty follows §6.3.

6.5 Failed Match (Spot Unavailable / Illegal)

If Seeker arrives but the spot is not usable:

Seeker: full refund + 30 SpotCoin credit
If Host caused failure: deduction = 30-coin credit + 10-coin Ops fee.

6.6 Strikes & Suspensions

2 failures within 30 days → 14-day suspension.
Fraud or spoofing → extended or permanent bans.

7) Map Access & Minimum Balances

Seekers must maintain ≥15 SpotCoins to view real-time departures.
Basic = limited map
Pro = full map + CurbAI
Plus = all Pro + Ticket Guard + CurbAI H2 (Hydrants view)

8) Data, Ads & Licensing

We may license aggregated, anonymized curb analytics (heatmaps, zone insights).
You may see sponsored pins or local ads.

By posting content (e.g., departure info), you grant Spotlink a limited license to use that content to operate and improve the platform.

9) Security & Payout Collection

Spotlink may send secure, time-limited payout links from info@spotlink.com.
Do not share bank data by DM or phone.
Links expire in 72 hours.

10) Acceptable Use

No GPS spoofing, falsified departure times, harassment, unsafe driving, off-platform payments, scraping, reverse engineering, or any unlawful conduct.

11) Subscriptions: Billing, Auto-Renewal & Cancellation

Subscriptions auto-renew monthly unless canceled.

Apple Users

If purchased via the App Store:

Billing is controlled by Apple.
Cancel through Settings → Apple ID → Subscriptions.
No in-app cancellation mechanism is permitted under Apple policy.
Apple manages all refund determinations.

General

No prorated refunds for partial months.
Access continues until the end of the billing cycle.

12) Account Deletion & Data Retention (Apple-Required)

You may request account deletion at any time by:

Using the Delete Account option in the Spotlink app (Settings → Account → Delete Account), or
Emailing support@spotlink.app from the address linked to your account.

What deletion includes

Upon verified request:

Your account, profile, and personal identifiers are deleted.
Location records, match history, payout logs, and transactional records are disassociated or anonymized as required for fraud prevention and financial compliance.

Retention & Exceptions

For legal, regulatory, tax, fraud prevention, and dispute-resolution purposes:

Certain logs may be retained for up to 24 months, then deleted or permanently anonymized.
Apple purchase records cannot be deleted by Spotlink; Apple retains its own logs per App Store policy.

Effect of Deletion

All SpotCoins (base + bonus) are forfeited and cannot be restored.
All active subscriptions must be canceled through Apple ID settings prior to deletion to avoid future charges.

13) Community & Environment

Spotlink promotes smoother curb turnover, reduced cruising, lower emissions, and shared mobility intelligence.

14) Changes, Termination & Enforcement

We may update these Terms and will post a revised effective date. Continued use means acceptance.

Violations (e.g., fraud, spoofing, chargebacks) may lead to suspension or termination.
On termination

SpotCoins may be withdrawn per §4.4 (unless held for investigation).

15) Legal Notices & Disclaimers

Spotlink provides information only. CurbAI and Ticket Guard are informational tools and do not replace posted signs or local law.

We do not guarantee parking availability, legality, or enforcement outcomes.

The service may be affected by municipal updates, latency, GPS drift, device limitations, weather, or outages. Service is provided “as is” and “as available.”

Pilot Programs & Discretionary Reimbursements

Spotlink may, from time to time, operate limited pilot programs or tests intended to evaluate new features, community initiatives, or user engagement models (“Pilot Programs”).

Participation in any Pilot Program is entirely voluntary and discretionary. Any reimbursement or payment offered as part of a Pilot Program (including, but not limited to, parking ticket reimbursements):

Is not guaranteed
Is not a contest, raffle, sweepstakes, or promotion
Does not constitute compensation for damages, losses, or penalties
Is subject to internal review, eligibility criteria, caps, and availability, as determined solely by Spotlink

Spotlink may contact selected users directly and privately to request additional information or documentation for verification purposes. Users should not submit documentation or personal information unless Spotlink has initiated such contact.

Reimbursements, if approved, may be issued by check mailed to the verified mailing address of the selected user, in the name matching the user’s identity documentation. Spotlink is not responsible for delays, loss, or non-delivery caused by incorrect or outdated address information.

Spotlink reserves the right to:

Decline any reimbursement request
Limit reimbursement amounts
Require proof or documentation
Modify, suspend, or terminate any Pilot Program at any time, with or without notice

Nothing in a Pilot Program creates an entitlement, expectation, or ongoing obligation on the part of Spotlink.

Limitation of Liability

To the fullest extent permitted by law:
Spotlink is not liable for tickets, towing, time loss, damages, or third-party actions.
Total liability is capped at the greater of $100 or the amount you paid to Spotlink in the prior 3 months.
Some jurisdictions may restrict this limitation; in those cases, the lawful limit applies.

16) Governing Law & Venue

Nevada law governs. Exclusive venue: state or federal courts in Clark County, Nevada.
