SPOTLINK TERMS OF SERVICE

1) Introduction & Acceptance

Spotlink (“Spotlink,” “we,” “us,” or “our”) is an information-exchange platform. Drivers who are leaving a curb space (“Spotters” or “Hosts”) share real-time departure details with drivers who are looking for parking (“Seekers”). Spotlink does not lease, sell, reserve, or guarantee any curb or parking space; we only provide timing and location information that Spotters choose to share.
By tapping Accept during sign-up or by using the Service, you agree to these Terms. If you do not agree, do not use Spotlink.

2) Service Overview (Instant Curb Intelligence)

Problem: Drivers lose ~100 hours/year circling for legal parking. Garages charge $30–$60/hr; alternate-side tickets start at $65.

How Spotlink works

  • Spotter: taps and sets departure time (“Leaving in 10 minutes”).

  • Seeker: pins a destination, sees live departures, spends SpotCoins (in-app credits that scale with lead time), and gets turn-by-turn guidance.

  • Auto-Link & Escrow: Coins are held until the Seeker’s GPS crosses a 10-ft geofence around the departing vehicle; on link, coins release instantly.

  • CurbAI & Ticket Guard (info only): check posted rules (street cleaning, meter hours, selected 311 alerts) to color-code blocks (🟢 legal | 🟡 risky | 🔴 no-parking) and send real-time rule alerts (notifications).

3) Accounts, Eligibility & Safe Use

You must be 18+ and legally able to drive/park.
Keep location permissions on for GPS-based features (Auto-Link, guidance, Ticket Guard).
Do not spoof GPS, block the curb illegally, harass users, or transact off-platform to evade fees.
One natural person per account; we may require identity or vehicle verification.

4) SpotCoin Token System

4.1 Parity & Packs

  • 1 SpotCoin = $0.10 USD.

  • Packs:

    • $5: 50 base + 0 bonus = 50 total

    • $20: 200 base + 20 bonus = 220 total

    • $100: 1,000 base + 100 bonus = 1,100 total

  • Base coins are cash-withdrawable (§4.4). Bonus coins are non-withdrawable and expire in 30 days.

4.2 Sign-Up & Referral

  • Welcome Pack: 50 bonus SpotCoins (=$5) on phone verification; expires in 30 days.

  • Referral: 20 bonus SpotCoins to inviter and invitee after first successful match; expires in 30 days.

4.4 Top-Ups & Withdrawals

  • Top-ups: minimum $5, maximum $100 per purchase | $1000/day.

  • Withdrawals (base coins only): minimum $10, maximum $2,500 per calendar month, per account. Pro and Plus plans only.

  • Withdrawal fee: 10% of the withdrawn base coins per request (bonus coins are not withdrawable).

    • Example: withdraw $100 (1,000 base coins) → fee $10 → receive $90.

  • We may require KYC/AML checks or holds for risk/legal compliance.5) Matching, Escrow & Auto-Link

A match forms when a Seeker selects a Spotter’s departure and funds escrow.
Auto-Link occurs when the Seeker’s device crosses the 10-ft geofence around the Spotter’s recorded curb location.
On Auto-Link, escrowed SpotCoins release automatically to the Spotter (subject to penalties in §6).
If GPS is inconsistent, we may request alternative confirmation.

6) Cancellations, Penalties & Failed Matches (all in SpotCoins)

6.1 Pre-Link Cancellation

Either party may cancel before Auto-Link without penalty.

6.2 Host (Spotter) Cancels After Match

If the Host cancels after a match is formed (but before Auto-Link):

  • The Seeker receives 100% of their SpotCoins back.

  • The Host is penalized 30 SpotCoins: 20 → Seeker (for time lost) and 10 → Spotlink Ops.

  • Plus subscribers receive one monthly penalty waiver.

6.3 Seeker Cancels After Match

If the Seeker cancels after a match has been accepted (but before Auto-Link):

  • The Seeker receives 100% of their funds back.

  • The Seeker is penalized 15 SpotCoins: 10 → Host (for time lost) and 5 → Spotlink Ops.

6.4 Seeker Arrives Late / No Show / Geo-Match Failed

If the Seeker fails to arrive within the designated window (typically 5 minutes) or a Geo-Match does not trigger due to Seeker inactivity:
Apply the same penalty structure as § 6.3 (Seeker Cancels After Match).

6.5 Failed Match (Spot Unavailable or Illegal on Arrival)

If the Seeker arrives but the spot is unavailable or illegal (e.g., vehicle did not vacate, posted sign prohibits parking):

  • The Seeker receives a 100% refund + 30 SpotCoin credit.

  • The credit and a 10-coin Ops fee are deducted from the Host’s balance if the Host caused the failure.

6.6 Strikes & Suspensions

Two failures (No-Shows or Post-Link Cancels) within 30 days → 14-day suspension (wallet locked).
Fraud, GPS spoofing, or chargebacks may lead to longer or permanent bans.

7) Map Access & Minimum Balances

  • Seekers must maintain ≥15 SpotCoins.

  • Basic Seekers: limited map access

  • Pro Seekers: full map access and street rule details (CurbAI)

  • Plus Seekers: All Pro benefits + heat-map access, and Ticket Guard

8) Data, Ads & Licensing

  • We may offer B2B data licenses (aggregated/anonymized heatmaps, zone analytics, APIs).

  • Sponsored pins/ads may appear; we keep them relevant and local.

By posting content (e.g., departures), you grant Spotlink a limited, non-exclusive license to use that content to operate and improve the Service.

9) Security & Payout Collection

Spotlink will email winners/payees a unique, time-limited secure claim link (from verify@spotlink.com or support@spotlink.com) to collect any sensitive payout details. Do not send bank information via DM. We will never ask for payout details in DMs or by phone.
Link expiry: secure links expire in 72 hours; unused links may lead to selection of an alternate winner.

10) Acceptable Use (What’s Not Allowed)

  • GPS spoofing, falsifying departure times, or listing spots you cannot vacate.

  • Holding or “reserving” public curb outside applicable law.

  • Harassment, unsafe driving/standing, double-parking to “guard” a space.

  • Off-platform payments to evade fees; multi-accounting to farm bonuses.

  • Scraping, reverse engineering, or exploiting the app/APIs.

  • Any conduct that violates law or endangers others.

11) Subscriptions: Billing & Cancellation

Subscriptions auto-renew monthly until you cancel.
Cancel anytime; access continues through the end of the current billing period.
No prorated refunds on partial months.

12) Community & Environment

Smoother curb turnover, lighter congestion, and richer curb data. Fewer cruising miles reduce fuel waste, CO₂, and noise.

13) Changes, Termination & Enforcement

We may update these Terms and will post the effective date above. Continued use means acceptance of changes.
We may suspend or terminate accounts for violations (e.g., GPS spoofing, fraud, repeated penalties, chargebacks).
On termination, you remain responsible for amounts owed; unused bonus coins expire; base coins may be withdrawn per §4.4 (subject to holds for investigations or law).

14) Legal Notices & Disclaimers (consolidated)

  • Information only; no legal advice. CurbAI and Ticket Guard provide informational alerts. They are not legal advice. Posted signs, official notices, and local law control.

  • No guarantee of parking. Spotlink does not lease, sell, reserve, or guarantee any curb space. Availability depends on user activity and city rules.

  • Accuracy & availability. Data may be affected by municipal updates, latency, GPS drift, device settings, weather, or outages. The Service is provided “as is” and “as available.”

  • Limitation of liability. To the fullest extent permitted by law, Spotlink is not liable for parking violations, towing, damage, loss of time, missed matches, or third-party actions. Spotlink’s total liability shall not exceed the greater of $100 or the amounts you paid to Spotlink in the 3 months preceding the claim. Some jurisdictions do not allow certain limits; those limits apply only where lawful.

15) Governing Law & Venue

These Terms are governed by the laws of the State of Nevada, without regard to conflicts rules. Exclusive venue lies in the state or federal courts located in Clark County, Nevada.
